ouch$500 deductible, it has been a bad week for cars in my family. This past Monday an uninsured motorist ran a red light and hit my wife, so yet another deductible. Between both of our cars there is around $8,000 of damage. All of course being paid from our insurance company.
You can try to sue anyone, but since all but the $500 deductible is paid by the insurance company you really can't claim the $8000. So what will happen is the insurance company will file a $7500 claim against the lady and try to collect on it. If she doesn't make arrangements to pay they will sell the claim to a collection agency and she will take a hit on her credit report.What's going to happen to the uninsured motorist? Can't you personally sue them?
There would be a citation from the police (if they come) but it's a civil violation i believe vs. criminal.Are there criminal charges for someone who causes an accident without insurance?
